Student-Athlete Name, Image, and Likeness (NIL) Policies, Procedures, and Resources

 
SUNY NIL Policy and Procedures
Effective July 1, 2021, all individuals participating in NCAA intercollegiate athletics, at any level, are permitted to benefit from their name, image and likeness (NIL) under the NCAA Interim Policy.  SUNY Poly and the Department of Athletics supports all individuals who would like to explore and utilize compensation opportunities for their NIL.  Please click the link above to review SUNY guidelines for student-athletes who wish to enter in an agreement to benefit from their NIL. 


Important Quick Facts to Know
A Student-Athlete may not enter into a contract providing compensation to the Student-Athlete for use of the Student-Athlete's name, image, and likeness if a provision of the contract causes a conflict, including if the proposed contract would:
  • cause the student to violate the Team Contract;
  • cause the student to violate the institution's student handbook or code of conduct;
  • conflict with an existing contract or sponsorship the institution participates in;
  • reasonably be judged to cause financial loss or reputational damage to the institution;
  • would require actions by the player during team activities;
  • use the institution's name, brand, copywritten materials, trademarks, service marks, symbols, nicknames, trade dress; insignia, mascot, uniform styles, colors, imagery, campus landmarks, or any other intellectual property of the institution;
  • would require the student to display a sponsor's product, logo, brand, or other indicia, or otherwise advertise for a sponsor, during official team activities or any other time, and such sponsor is a competitor of, or offers products or services within the same category as a sponsor of the institution; or
  • Other potential conflicts that could cause harm to the institution
Student-athletes may not receive compensation for athletic participation or achievement (e.g. compensation based on points scored).  Athletic performance may enhance a student-athlete's NIL value, but it may not be considered for NIL compensation.  

NIL compensation cannot be contingent on initial or continued enrollment at a particular school.

A student-athlete may not receive compensation without work performed.

SUNY campuses, including their employees, contractors, representatives, and agents, may not create or facilitate name, image and likeness opportunities for prospective Student-Athletes as a recruiting inducement or for current Student-Athletes as an inducement to remain enrolled at a SUNY campus.



SUNY Poly NIL Disclosure Requirements/Form
The NCAA and SUNY Poly requires that student-athletes disclose their NIL opportunities, including compensation arrangements and contact information for all parties involved in the NIL activity.  Such disclosure should be made at least 7 days prior to committing to the activity, with all necessary details to ensure the student-athlete is following all applicable guidelines.  Any changes made after the initial disclosure should be brought forward and resubmitted.
